Events & Elopements
CANCELLATION POLICY
Client Cancellation
If you cancel your confirmed booking after the 30% non-refundable deposit has been received by Montville Estate you will forfeit your deposit and your event date will be able to be booked by others.
If you cancel your booking within 90 days of your event date you will forfeit the non-refundable deposit and any payments made to date and your event date will be able to be booked by others.
If you cancel your booking after the final payment has been received by Montville Estate within 30 days of your event date, you will forfeit the deposit, all payments and final payment and your date will be able to be booked by others.
Any deposits/fees incurred by Montville Estate from managing external vendors/services for your event will be subject to the vendors cancellation terms and payable by You.
Montville Estate Cancellation
Montville Estate may terminate this agreement, that has been agreed and entered into by You through payment of deposit by written notice if any of the following events has occurred (or is, in Montville Estate’s reasonable opinion, likely to occur):
Montville Estate ceases to offer the Event Services;
Montville Estate believes the professional relationship between Montville Estate and You has broken down beyond repair;
Montville Estate believes that we cannot in good faith provide the specific event services that you require; or
Montville Estate believes that any other circumstances exist so as to render the provision of the event services unfeasible. .
If Montville Estate cancels the event services in accordance with the above, Montville Estate may refund any payment made by you, less any other amount reasonably required to compensate Montville Estate for event services provided up to the point of cancellation.
Postponement & Reschedule
If you request that an event date be postponed/rescheduled to an alternate date, such postponement is subject to Montville Estate’s acceptance
If we agree to postpone/reschedule an event date, such postponement is subject to your agreement that:
we may be unable to accommodate a similar day, date or time, and the new event date will be subject to You and Montville Estate agreeing to a mutually agreeable date and time that is available to be booked;
our pricing structure then current for the new event date will apply, including any increase arising from our annual price increase;
any money paid by You will be credited towards your new event date, however You will not be entitled to a refund of any amount paid; and;
in our sole discretion, we may retain any payments if we incur any loss as a result of postponing an event date.
BOOKING POLICY
For elopements and events at Montville Estate, You must book directly through Montville Estate and not through Airbnb/Third Party. Any bookings booked via Airbnb or third party will be cancelled and rebooked directly.
CHECK IN & CHECK OUT
Events and Elopements incur a three-night minimum stay. The Standard check-in time is 3.00 pm the day before the scheduled event and the accommodation is to be vacated by 10.00 am on the day of departure. Early arrivals and late check-outs are at the discretion of management and must be requested at the time of booking.
PAYMENT POLICY
All payments must be made by direct bank transfer to our nominated bank account.
Payments for Events & Elopements
To secure your event date more than six months in advance, a 30% deposit of the total quoted price is due within 7 days of receiving your invoice. This payment is strictly non-refundable.
To secure your event date less than six-months in advance, a 50% deposit of the total quoted price is due within 7 days of receiving your invoice. This payment is strictly non-refundable.
A further 35% deposit is due 60 days from your event date.
The final and residual 35% amount owed is due 30 days before your event date. This payment is strictly non-refundable, on the basis that it represents the value of the loss that would be suffered by Montville Estate if the event did not proceed after this date and you agree that this amount is fair and reasonable with respect to the event services provided by Montville up until this date and in anticipation of the event occurring on the event date.
If the monies are not received 30 days before your event date your booking will expire, your date will be available to be booked by others and you will forfeit you all payments made.
‘Short’ Bookings for Events & Elopements
If Montville Estate accepts a booking for an Event Date that is sooner than three months to fourteen days from the booking date, then Montville Estate may require full payment upfront or in accordance with an adjusted payment schedule. Any payment made pursuant to this clause is strictly non-refundable on the basis that it represents the value of the loss that would be suffered by Montville Estate if the event did not proceed after this date and You agree that this amount is fair and reasonable with respect to the event services provided by Montville Estate up until this date and in anticipation of the event occurring on the event date. For clarity, this clause does not constitute an express or implied agreement that Montville Estate would accept an event date within such period of time.
SECURITY BOND
A security deposit of $1000 will be held from a valid credit card. Your credit card will only be debited in the event of not adhering to the terms and conditions, damage to the property, equipment, breakages, missing items or if extra cleaning is required at the discretion of management.
HOUSEKEEPING
Bookings for events do not include daily housekeeping. Additional housekeeping can be arranged if requested in advance at a fee.
SMOKING
Montville Estate and the grounds are strictly no smoking including the use of e-cigarettes. Smoking and e-cigarettes are strictly prohibited on site and inside any rooms, balconies, common spaces or anywhere on the property. Should You or any other person staying with You be found to be smoking or find traces of smoking in scent or burn marks, Montville Estate reserves the right, at its absolute discretion, to cancel your booking, in which case, You will be asked to immediately to leave the premises. Any payment which You have made to date under this agreement will not be refunded to You and a minimum cleaning fee of $500 will be charged to the card on file.
PERSONAL BELONGINGS
You acknowledge that we do not cover your personal belongings under our insurance policy and therefore take no responsibility for any loss or damage of the occupant's personal property left on the premises and agree that You will not make any claim against us for any damages or loss to your personal belongings regardless of how or where the loss or damage occurred.
CHILDREN & PET POLICY
Children are permitted on the property for private events, however should always be under adult supervision and must never enter the pool area alone.
We allow pets by application only and if accepted, upon approval we have a $70 pet fee for Exclusive Estate Bookings. If pets are found to have been on furniture or to have damaged any property, a $500 cleaning fee will be charged to the card on file.
EXCLUSIVE USE
Events and Elopements from Friday - Sunday can only be held at Montville Estate if the whole of estate is booked for exclusive hire. Cottage & Ground Only Events and Elopements can only be booked Monday - Thursday in off peak periods (no public holidays, school holiday periods) at our discretion.
VENDORS & SCHEDULE
All vendors and services used for events and elopements must be approved by Montville Estate. All vendors must have correct insurances to operate on the property. Event schedules must also be supplied to Montville Estate 30 days in advance of the event for approval to ensure they are inline with residential restrictions and estate protocol.
CONDUCT AT AN EVENT
You agree to begin your Event at the scheduled time and agree to have all guests, invitees and other persons vacate Montville Estate at the closing time, 10pm. Entertainment must also finish at this time.
You are responsible for the conduct of your guests and vendors (all sub, and You, your guests and your vendors must conduct yourselves in an orderly manner and in full compliance with applicable laws. You must use all reasonable endeavours to ensure no disturbances or nuisances will be caused to any guests, visitors or neighbours of Montville Estate.
You are responsible for ensuring that any vendor which You engage to provide services holds reasonably suitable insurance relating to the services they are providing, including (but not limited to) public liability insurance for a minimum of $20million for any one occurrence.
Management reserves the right and will remove any guest or vendor from the Event whose behaviour is objectionable or undesirable.
To the fullest extent permitted by law, You and your guests and vendors release and indemnify Montville Estate from and against any and all claims, losses, damage, liability or third party losses arising from the conduct of You, your guest or any of your vendors, except to the extent it arises directly from Montville Estate’s wilful or negligent act or omission.
ENTERTAINMENT AND NOISE RESTRICTIONS
Due to the residential location of Montville Estate all music/entertainment must be turned down by 8pm and cease no later than 10pm. This is a Council requirement.
Amplified music outside the House or in the grounds is not permitted, except through our outdoor sound system, which must not exceed 70db.
Amplified music within the House must not exceed 90db and the House doors must be shut after 10pm regardless of whether amplified music is playing.
Montville Estate records sound levels and reserve the right to turn or shut down any amplified music at any time to comply with Sunshine Coast Regional Council.
Montville Estate reserves the right to control the quality, style and volume of any entertainment booked.
All entertainment in every form must be discussed and approved by prior to your Event. We reserve the right to refuse approval of entertainment in any form prior to the Event if it does not conform to our guidelines.
BEHAVIOUR
We are in a residential area and would ask that You respect our neighbours at all times. Parties or gatherings are strictly prohibited unless prior arrangements have been made with Management. Disturbance to other guests and neighbours including excessive noise and music is prohibited and may result in eviction without refund. If a noise complaint is received the first warning will be given, if a second complaint is received this will result in immediate eviction with no refund.
PARKING
Parking is not permitted anywhere on the property other than in the designated carport and gravel driveway. Parking is not permitted on the Western Avenue road side fence lining the property. Parking must not obstruct any entrances to the property of neighbouring properties/driveways.
All guests must park in the FREE Montville Russell Family Park Carpark, a short 4-minute walk from the property.
EVENT CLEAN UP & RUBBISH
Montville Estate must be left in the manner in which you found it. All vendors are responsible for cleaning up after themselves and disposing of any rubbish. You as the guest are responsible to ensure the Estate is returned to its natural state the day following the event. Please dispose of any rubbish in the allocated bins and take with you any overflow rubbish. Additional cleaning/rubbish collection fees may be charged to the guests credit card if the Estate is left in an unacceptable state.
FURNITURE
House furniture including, chairs, tables, lounges etc cannot be moved/relocated without prior approval. If approval is granted the guest must place furniture back exactly where they found it upon check-out. If the approved furniture is left misplaced, a relocation fee from the Security Deposit provided will be taken. If any damages are made to the furniture, house, grounds during the relocation process, a fee will be charged representative of damages. See further below;
BREAKAGES AND DAMAGES
Damages or breakages of furniture or furnishings must be reported to management immediately. Breakages or damages to the property and all communal or external areas that are caused by any guest and/or a guest's visitor will be charged and recouped in full from the guest's credit card. Excess cleaning required on departure or replacement of items removed from the accommodation will be charged to the guest's credit card. Furniture, fixtures and fittings are not to be altered or moved between rooms or properties. There will be a charge incurred if the furniture is not returned to its original location.
CONFETTI
No paper/plastic/biodegradable confetti, rice or glitter throwing is permitted – however fresh rose petals or bubbles are acceptable outdoors on lawn only. You will be liable for any breach of this and damages caused will be charged to the credit card on file. Montville Estate reserves the right to alter the décor, fixtures and fittings within the property at any given time without notice to you.
LIABILITY AND INDEMNITY
The following limitations of liability apply:
You acknowledge and agree that Montville Estate will not be liable to You, your guests or your vendors for:
any loss or damage of any kind that is directly or indirectly caused by or results from the event services, these terms or the matters to which they relate or are in any way connected to it; and/or
any direct, incidental, special or consequential damages, including loss or profits or anticipated profits, even if notified of the possibility of that potential loss or damage;
To the extent that it is not directly caused by Montville Estate wilful or negligent act or omission; You release Montville Estate from any liability or claims including, but not limited to:
any personal injury, illness or death caused to You, your guests or your vendors; and
any breach of Your obligations; to the extent that any liability or claim is not directly caused by Montville Estate wilful or negligent act or omission.
You acknowledge and agree that the limitations of liability are essential to Montville Estate and Montville Estate would not have agreed to enter into an agreement with You in their absence.
You indemnify Montville Estate for:
all losses and expenses Montville Estate incurs (including legal costs on an indemnity basis); and
all liabilities Montville Estate incurs; directly or indirectly caused by, or resulting from any breach of these Terms & Conditions or from any wrongful, wilful or negligent act or omission by You.
Any representation, warranty, condition or undertaking that would be implied in these Terms & Conditions by legislation, common law, equity, trade, custom or usage is excluded to the fullest extent permitted by law.
Montville Estate’s total aggregate liability for all claims relating to these Terms & Conditions is limited to the any fees payable under these Terms & Conditions.
These Terms & Conditions are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, guarantees, conditions or obligations. If such legislation applies, to the extent possible, Montville Estate limits its liability in respect of any claim to any amounts paid pursuant to these Terms & Conditions.
FORCE MAJUERE
Montville Estate will not be liable for any loss incurred by You as a result of any required alternations, postponement or cancellation of any or all of the event services or to observe any of these terms due to a prescribed event. During the continuance of a prescribed event, Montville Estate’s obligations under these conditions will be suspended and Montville Estate is not under any obligation to take steps to bring a prescribed event to an end.
PHOTOS & VIDEOS
You acknowledge and agree that Montville Estate may take or receive images or videos of You and/or your guests, vendors or other persons involved in the provision of the event services (the Photos and Videos).
You acknowledge, agree and consent (and agree to obtain consent of all guests and vendors, including from parents and/or guardians of minors, where applicable) to being photographed and/or videoed during the provision of the Event Services and such consent is deemed to have been received from You unless otherwise communicated to us in writing;
You warrant that Montville Estate has all necessary consent and permission to view and use the Photos and Videos for marketing and promotional purposes on our website, social media pages, and/or any other media type included television, newspaper or other print mediums, unless You have specifically notified us at the time of entering into these Terms that You do not consent to the use of the Photos and Videos.
You acknowledge, agree and consent that for security reasons, Montville Estate has a number of cameras throughout on the Premises, including throughout the gardens which are monitored and recorded. Montville Estate will only use any recorded images or videos from our security cameras for security and monitoring purposes, and will not market those images or videos.
CONFIDENTIALITY
You agree not to disclose any confidential information or allow it to be disclosed any person or related corporation except:
with our prior consent; or
in accordance with any lawful requirement.
Except as allowed for above, Montville Estate reserves the right to refuse to provide any details or information (including confirmation as to whether You have a booking with us) relating to your Event Services to any person who requests them, and You indemnify us from any costs, loss or damage you suffer as a result of our refusal.
INTELLECTUAL PROPERTY
The parties acknowledge and agree that all content, data, know-how, techniques, technology or other information that is conceived, invented, developed, improved or acquired in connection with the Event Services (the ‘Intellectual Property’) is the property of Montville Estate, and vests in, Montville Estate. You are not permitted to use the Intellectual Property in any way without Montville Estate’s prior consent.
The Intellectual Property includes (but is not limited to) the content created by Montville Estate in delivering the Event Services.
CHANGES TO THESE TERMS AND CONDITIONS
Montville Estate reserves the right to make reasonable changes to these terms and conditions if required at any stage and will provide You with written notice of any changes to these terms and conditions, for your acceptance.
BREACH OF TERMS AND CONDITIONS
You agree that should You or your guests breach any of the terms and conditions: You will pay to us the total loss or damage that we suffer as a result of that breach and hereby authorise us to debit your credit card or apply your refundable deposit in payment of that loss or damage and we may evict You and your guests without notice.
